New obligations for companies regarding packaging and packaging waste

María José Rovira, partner in the environmental practice, has published an article in the latest issue of Revista AJA on the new obligations for companies regarding packaging and packaging waste.

The future regulation in this area will affect our current legislation, the purpose of which, according to our lawyer, will be “to avoid distortions in the functioning of the internal market resulting from national transposition rules, and to promote the circular economy by encouraging the sustainability of packaging.”

When is this regulation expected to be approved? “It is expected to be published in the last months of the year,” says our expert. 

How will these packaging obligations affect companies? Rovira offers a message of reassurance: “Most of its provisions will not be automatically applied insofar as they either have a specific timetable for implementation or need to be specified through delegated acts,” which allows for some leeway for adaptation. 

Furthermore, she is confident that the authorities “are already acting in line with the future regulation, so that they are adapting requirements or authorizations currently being processed, for example, in the establishment of DDR systems in open circuits.”
