Interview: New data protection regulations in hotels and the arrival of AI

The hotel sector in Spain has new regulations on guest data protection, which impose greater obligations for managing guests' personal information, with more rigorous measures for collecting and securing personal data. Hotels will also have to adapt to the implementation of artificial intelligence, which, while beneficial, also requires specific adjustments to prevent privacy breaches.

In this interview for Confilegal, experts in the field such as our lawyers Ramón Mesonero-Romanos and Ingrid González, partner and manager respectively of the data protection and digital law area, outline the main issues imposed by the new data protection regulations. They advocate that hotels always comply with it, but the accessibility and comprehensibility of the data provided by guests when they sign the “accept all” clauses must be guaranteed.

They focus on a sector in which the AEPD has imposed many sanctions on hotels for collecting excessive data, such as photocopying ID cards. They analyze issues such as how to respond to data breaches, what rights guests have when visiting a hotel, and whether a hotel can refuse accommodation to a guest who refuses to provide their data. Finally, they analyze how artificial intelligence can be implemented in hotels while safeguarding the rights of both the hotel and its guests.
