After more than 15 years of constant evolution of the Cosmetics Regulation, the European Commission has launched a more in-depth analysis through the REFIT program (European Commission's regulatory fitness and performance program). The results may influence future changes to the regulations for the cosmetics sector.
Alejandro Alonso, a partner in the commercial law department, explains this in his article for Revista VPC: “The aim of the REFIT program is to simplify European legislation, making it easier to comply with and reducing regulatory costs, while achieving the objectives of the regulation.”
Our commercial law expert explains what it consists of: “The first phase of this evaluation process consisted of a period of data collection called a ‘call for evidence’ in which any interested party could send their comments and observations.” [] After receiving more than 150 responses, it has revealed the main concerns and suggestions of many market participants that could translate into changes in European regulations.
The most recurring topics discussed in these responses regarding the cosmetics sector were: “Labeling; product safety in relation to digital commerce; bureaucratic obstacles for small businesses; animal testing; among others.”
